GOOD NEWS...!

25-08-2011

Today, Honorable Justice Chandru pronounced a highly favourable order for our side to rejoice!

* He has Ordered the State Government to find a novel way to monitor minority colleges (that are getting aids from the Government).
* He also suggested the Government to enact new laws or evolve means to control such minority institution and to protect such institutions.
* Regarding salary for all the staff members (Teaching and non-teaching), he has directed the Government to disburse the salary through JDCE until the controversy between the petitioners ('the illegal' occupant Mr. R. Mohan and the legitimate Principal-in-charge Dr. P. R. Anbudurai) and other contesting respondent and the group backing him (Mr. Asir) are resolved in the manner known to law.

In the present case filed by Christopher Asir, had two prayers -
1. to quash the 'show cause notice' issued to him (and also to Mr. Mohan and Dr. P.R. Anbudurai) that seeks him to explain why the Government cannot appoint a special officer to run the college.
2. to allow Mr. Mohan to claim and disburse the salary for faculty and non-teaching staff (as the Principal and Secretary of the college).

In the Judgement, the honorable Justice Chadru has clearly said,
For the first prayer -  with the present law the Government cannot appoint a special officer in a minority institution and hence suggested the Government to enact new laws.
For the second prayer: the Government told the court that they HAVE NOT GIVEN ANY APPROVAL FOR either MR. MOHAN  or to Dr. P.R. Anbudurai and both cannot claim the salary in the present situation. Hence the Judge gave directions to the Government to disburse the salary through JDCE.

Now the questions that remain are....

First of all ...Who is Mr. Mohan..?
How can he break open the college and administer the college...? and How can Police then give protection to him?
How can he transact business on behalf of the college with other institutions, the JDCE office and the NCC Office...?
How can Mr. Mohan in collusion with Davamani Christopher, illegally draw money from the bank..? He is criminally liable for this act...
How can he conduct examinations... for students when he is NOT the the Head of the institution...?
How can he appoint staff members..?
How can he make admissions for the Academic programs, when he is NOT the Head of the institution.?

Dr. A.R.Venkitaraman writes ...

Dear Sam,

There is satisfaction, relief and happiness that the Madras High Court has at least resolved the question of unpaid salaries to the faculty and other staff at the American College. The hope is that the payments will continue without interruption hereafter. The judgement appears to be strong and unequivocal on that point. I applaud the faculty for patiently waiting without losing hope. My felicitations to them.

Let us hope that there is now the wherewithal along with will to fight the College's cause until the right and final denouement. Best wishes for success.
