Nexus between DCE, CSI Bishop alleged

The petition submitted said that the former Principal had forwarded a proposal for re-employment to DCE as Principal on November 1 since he was to go on superannuation fulfilling all the conditions for re-employment.
On November 19, DCE faxed a message seeking the former Principal to forward the proposal through CSI Bishop who is the President of the Governing Council.
Since the Bishop had obtained a stay for convening the Governing Council, the former Principal and Secretary of the College had to forward the proposal on his own and this was clarified to the DCE, the petition said.
Instead of responding to the communication, the DCE kept the matter pending till the date of superannuation of the former Principal and responded in a communication which was faxed to the College on Nov 30 at 7.45pm rejecting the submission of the then Principal assigning a new reason that the proposal was not forwarded through the Governing Council. Which the petitioner cited was an attempt to destabilise the administration and pave awy for the Bishop to intervene in the College affairs.
The petition stated that Jaikumar had moved Court and two of his writ petitions were admitted. However, the miscellaneous petition weren’t. Therefore, he handed over the Charge to PR Anbudurai according to the bye-laws of the College. Meanwhile, Christopher Asir appointed his candidate R Mohan as the Principal.
All the records pertaining to handing over charges from Jaikumar to Anbudurai had been duly filed with the Joint Directorate of Collegiate Education and DCE fulfilling the obligations under governing laws of the College and also the statutory requirements of the Private College Regulations Act after getting the nod of the Governing Council in its meeting held on Dec 6.
The JDC and DCE also did not acknowkledge Anbudurai’s letter seeking clarification on the deliberate leak of communication approving the Bishop’s candidate while the Bishop was not the official correspondent in this regard. No copy of the letter was marked to the Secretary of the College. “If Jaikumar’s proposal had to come through the Governing Council then how come Mohan’s candidature, which came through the Bishop was accepted?” the petitioners questioned.
The DCE and JDC have violated the High Court orders which restrains Bishop from any powers in appointing the Principal and also violated the laws of the Governing Council of the College, the petition submitted and observed that the illegality of the Public Servant might be carried out to reciprocate pecuniary favours earned from the Bishop. The petition has been submitted by the elected members of the Governing Council, J.John Sekar and S.Suriyakumar.
